Issues: What LEGAL question(s)
is (are) to be answered? This is the focus of the analysis. Remember that we
are concerned with the LEGAL issues here. Factual issues only matter to the
determiner of the facts (usually a jury, sometimes a judge). Think of
yourself as a judge, not a member of the jury, in order to frame the
issue(s). Identify the one or two MAIN ISSUES to be decided. |

Analysis: This is the bulk
of the brief. It is the most important part of the assignment. This typically involves stating
the plaintiff’s (π’s) legal argument. Identify, list, and summarize the
π’s arguments that can help answer the issue in her/his favor. Here, you
may relate the facts to the rule and issue. Next, analyze the situation from
the defendant’s (∆’s) or respondent’s position. Again, identify, list,
and summarize the ∆’s analysis of the case. |
